My Travel Agent, Inc. is a professional family-owned travel agency serving clients in the local community and nationwide since 1990. We help you arrange vacations worldwide, including, but not limited to, air transportation; accommodations to suit all budgets and tastes; ground transportation and car rental; sightseeing, excursions, ocean, and river cruises; rail and other means, and travel insurance options. Most of our services are provided for free however, some have a service fee.

YOUR AGREEMENT WITH MY TRAVEL AGENT INC

THIS DOCUMENT CONTAINS VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. PLEASE READ IT CAREFULLY. My Travel Agent, Inc. (“MTA”) acts as sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other travel service provider named in your itinerary ("Suppliers"). MTA is not responsible for acts or omissions of Suppliers or their failure to provide services or adhere to their own schedules. MTA assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under MTA's control. You hereby waive and release MTA from any and all claims arising out of or attributable to any matter covered in this Agreement. You hereby agree to submit any other claims related to your use of MTA’s services within 30 days after the return of your trip. You agree that the courts in DuPage County, Illinois will be the exclusive jurisdiction and venue for all claims brought by you or MTA, and you hereby submit to the personal jurisdiction of those courts. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of Illinois without giving effect to any choice or conflict of law provision or rule (whether of the State of Illinois or any other jurisdiction). YOU AND MTA IRREVOCABLY AND UNCONDITIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN RESPECT OF ANY LEGAL ACTION ARISING OUT OF OR RELATING TO THIS AGREEMENT.


MTA has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, MTA recommends contacting the Travel Warning Section of the U.S. State Centers for Disease Control at (800) 232-4636 or www.cdc.gov/travel.


Passport: You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s). Passport must be valid for at least 6 months after your return date.


Airline/s ticket/s: Tickets require exact name as on valid passport. Once an airline ticket is issued it is non-refundable, non-transferable and will carry a change fee per the airline policies, if changes are permitted. Basic Economy tickets are non-changeable regardless of reason. Visit the airline website to view seat and luggage information and any additional notifications. Note, itinerary is subject to change due to unforeseen reasons.


Terms and Conditions of tours, cruises, or services set forth in the brochures or circulars of Suppliers shall also apply to all clients of MTA. On behalf of our clients, MTA will send a “complimentary room upgrade and/or special room requests” prior to your departure date; however, requests of any kind are not guaranteed until confirmed by hotel at check-in. This Agreement constitutes the sole and entire agreement of you and MTA with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.

PAYMENT & FEES

I authorize My Travel Agent, Inc. to charge my credit card for agreed payment/s
My Travel Agent, Inc. has a $100.00 per reservation cancellation fee for services rendered that is not covered with any Supplier's insurance. The $100.00 cancellation fee must be paid before any cancellations or changes are made to your reservation. We will charge the credit card on file if you wish to cancel. If your reservation was paid in cash, we will not be able to make any cancellations until the cancellation fee is received. We strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased. As our client, you hereby appoint MTA to act on your behalf for the purpose of signing all documents necessary to purchase and issue airline tickets, tours, cruises, and hotel guarantees for late arrival. You authorize MTA to sign credit card authorizations for said purchases whenever we receive an Internet booking request reasonably believed to be from you or someone acting on your behalf, requesting those tickets be charged to your credit card account. You agree that you will pay for all such purchases and will not hold us responsible for any of our actions pursuant to this Agreement.

REFUNDS

Availability of refunds for unused travel reservations will vary with the type of reservation and the point at which your reservations were not used. Service fees for refunds may be applied. In the event of any Supplier bankruptcy, you should seek refunds directly from the Supplier or bankruptcy court. The refund process can take several weeks from the date of your written notice to MTA that you wish to cancel. In most cases, vacation deposits are non-refundable unless travel insurance was purchased. The cost to purchase travel insurance is typically never refundable. If a refund is applicable, Suppliers refund terms may vary, and refund may be provided in the form of future travel credit or voucher.

TRAVEL INSURANCE

For your protection, we strongly recommend that you purchase trip cancellation insurance. As your travel agency, we feel it is necessary to make you aware of travel protection insurance options. If your invoice does not state you have purchased such insurance and you wish to have cancellation insurance, please notify us within 24 hours of deposit or travel insurance may not be able to be added.

This Agreement and the terms and conditions herein apply to all travelers when booking a reservation for a group. Please indicate the full legal names for all travelers in your reservation, and by signing below you agree to inform all travelers in your booking of the terms and conditions hereof, including, but not limited to, the travel insurance protection suggested above.
